Garrett Wade “Maker of the Year Awards” Contest
The Garrett Wade Company, Inc. (“Garrett Wade”) “Maker of the Year Awards” Contest (the “Contest”) begins on ____June 1, 2021____ and ends on ___August 16, 2021_____________, at 5:00 PM EST. By submitting an entry, each contestant represents that he/she understands, agrees to, and accepts the Rules of this Contest as set forth herein, and that he/she is 18 years or older. If any of the foregoing is not correct, you are not permitted to enter the Contest or make any submission to Garrett Wade in connection with the Contest.
WHO MAY ENTER:
On individuals residing in the United States who are 18 years or older at the time of submission. Employees or independent contractors of Garrett Wade and its affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited. Garrett Wade shall determine the winner’s eligibility in its sole and absolute discretion.
HOW TO ENTER:
All images submitted as part of the Contest must contain fall into at least one (1) of the following categories:
● Cooking/Baking
● Floral/Garden Crafts
● General Arts & Crafts
● Knitting/Crochet/Sewing
● Modelmaking
● Papercraft
● Woodworking
To be eligible, your photograph must be original. By submitting a photograph for consideration, you represent and warrant that you are the sole creator and copyright owner of the photograph which is submitted.
For any images which contain a person or people who is/are identifiable or recognizable, as determined in Garrett Wade’s sole and absolute discretion, you must be prepared to provide a model release, in the form provided by Garrett Wade, from the subject, or in the case of a minor, from the subject’s legal guardian. Similarly, to the extent any image contains the work of another person (i.e., another image, a piece of woodworking made by someone other than the individual submitting the image, etc.), you must also be prepared to provide a model release, in the form provided by Garrett Wade, from the subject, or in the case of a minor, from the subject’s legal guardian. To the extent such a release is not or cannot be provided upon request from Garrett Wade, Garrett Wade reserves the right in its sole discretion to exclude the entry from consideration, obtain the appropriate release itself, or permit the entry to remain in the contest, including by cropping or otherwise removing a portion of the image.
Any photographs which: (1) violate or infringe upon another person’s or entity’s rights, including but not limited to copyright; (2) are of a sexual, obscene, illegal or violent nature, or otherwise, as determined in the sole discretion of Garrett Wade, or are objectionable or contrary to the interests of Garrett Wade; or (3) depict the use of any product or item in a dangerous or inappropriate manner, shall be deemed ineligible for consideration.
HOW TO ENTER:
Please submit any photograph you wish to enter the contest through the following link at the Garrett Wade website: https://garrettwade.com/maker-of-the-year-award-contest/ Alternatively, you may submit your photograph at makers@garrettwade.com in subject line: Maker of the Year Award Submission________________.
You may submit up to _5_ photographs. Once submitted, and entry cannot be withdrawn, and you may not substitute entries. All photographs must be submitted in digital jpeg format with a minimum pixel width of 1280 and an image resolution of 300 ppi. GIFs are also acceptable if they make sense for the submission-the same specifications for jpeg submissions apply here. Only one individual may enter photographs for each e-mail address.
Garrett Wade does not accept photographs by mail, by hard copy, or by any other means except as set forth above.
In addition to any release form as explained above, all winners must be prepared to submit an original, unedited digital file or original negative print. All originals, upon request, will be returned.
While you retain your rights in and to your photograph(s), by submitting any photograph for entry into this contest, you grant Garrett Wade a royalty-free, worldwide, perpetual, license to publicly or privately use, display, modify, distribute, edit, reproduce and/or create derivative works, in whole or in part, in any form or media currently existing of which may exist in the future, for any purpose, including but not limited to, advertising, marketing or promotion of Garrett Wade, its website or catalogs or any other marketing, its services, its products, or any products it sells or markets, or for any other exhibition, marketing or commercial purpose. Any photograph so used by Garrett Wade will, to the extent reasonably feasible considering the particular purpose for which the photograph is used, include photographer credit. Under no circumstance will Garrett Wade be required to provide any additional consideration to exercise any of its rights hereunder, nor shall Garrett Wade be required to seek or obtain any further approval for use of any photograph entered into the contest. No withdrawal or attempt to withdraw a photograph from consideration in the contest shall limit the license provided to Garrett Wade in such photograph.
DEADLINE FOR ENTRY:
The contest starts on June 1, 2021. All entries must be received no later than June 22, 2021. Garrett Wade is not responsible for any error, defect or any other technical issue which prevents you from submitting your photograph or entry within the required time period, nor for any inability of Garrett Wade to receive any photograph or entry. Garrett Wade will not confirm receipt of entries.
SELECTION OF A WINNER:
Winners will be contacted via the contact information provided in the entry as of the time of entry. Garrett Wade reserves the right to disqualify any winner whose response and acceptance of the winner’s prize is not actually received by Garrett Wade within five (5) days of Garrett Wade contacting the winner. Garrett Wade is not responsible for any technical or other problems in connection with such communications.
PRIZE:
The winner will receive a One Thousand Dollar ($1,000.00) Gift Card redeemable at Garrett Wade. The Gift Card shall have no cash value and cannot be redeemed for cash. In addition, the winner’s photograph shall be featured in the Garrett Wade December 2021 catalog (or thereafter).
The winner must comply with all rules and requirements set forth herein, and sign a license and release form, as well as a declaration of eligibility, and the winner shall be responsible for all taxes or other fees associated with the prize. All prizes, including any products obtained from Garrett Wade, are provided “as is” and are non-transferable.
OTHER CONDITIONS OF ENTRY:
All entrants into the Contest shall hold Garrett Wade and its affiliates, subsidiaries, owners, officers, directors, employees, lawyers, interns and agents, and their respective partners, representatives, successors and assigns (together, the “Indemnified Parties”) harmless from and against any and all claims of any kind or nature arising out of or in connection with this Contest and entrant’s participation in the Contest, including but not limited to acceptance of any or all of any prize and the granting of the license to Garrett Wade set forth herein. The Indemnified Parties shall not be liable for, and every entrant, by entering the Contest hereby forever releases and discharges the Indemnified Parties from and against, any costs, claims, injuries or damages of any kind as a result of entrant’s participation in the Contest or acceptance of any or all of any prize or the granting of the license to Garrett Wade set forth herein. The Indemnified Parties are not responsible for any incomplete or misdirected entries, technical or network malfunctions or failures or any other causes or problems beyond its control.
Entrants may not submit any photograph, entry or other materials which include or introduce any works, virus, malware, or other programs which, intentionally or not, damage or harm in any way Garrett Wade’s software, hardware, or telecommunication equipment, or which fail to comply with the entry obligations for the Contest.
Anyone violating any of these rules or conditions will be removed from the contest, and any prize(s) may be withdrawn.
The Contest is void where prohibited by law and may be withdrawn or these rules modified at any time and for any reason by Garrett Wade.
DISPUTES:
All decisions of Garrett Wade with respect to this Contest shall be made in Garrett Wade’s absolute discretion and are final and binding. Any dispute concerning
This Contest is governed by the laws of the United States and the State of New York without respect to conflict of law doctrines. As a condition of participating in the Contest, all entrants agree that any and all disputes which cannot be amicably resolved between all parties, and all causes of action arising out of or connected in any way to this Contest or your actual or attempted participation there, shall be resolved individually, without resort to any form of class action, exclusively between the state and federal courts located solely within the State of New York. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., out-of-pocket costs, if any, actually incurred by you directly associated with entering this Contest), and you further waive all rights to have damages multiplied or increased.
PRIVACY NOTICE APPLICABILITY:
All information submitted by or on your behalf with any entry or attempted entry into, or communication with Garrett Wade concerning, this Contest shall be subject to Garrett Wade’s Privacy Notice, which can be found at: https://www.garrettwade.com/privacy-notice.
